1. Introduction
Welcome to Wayanad Trip Planner LLP (“we”, “us”, “our”). We are a licensed travel and tourism service provider offering curated travel experiences in Wayanad and other destinations across India. By accessing or using our official website (www.wayanadtripplanner.com) or booking a service with us, you agree to comply with these Terms and Conditions (“Terms”). If you do not agree, please refrain from using our services.
2. Eligibility
By using our website or booking services with us, you confirm that you are at least 18 years of age and possess the legal capacity to enter into a binding contract.
3. Services and Booking
- 3.1 Service Locations & Itinerary: All services begin from the pickup point mentioned in your booking confirmation. Sightseeing and travel itineraries may cover different parts of India and conclude at the original pickup location unless otherwise specified.
- 3.2 Pricing: All prices include applicable taxes unless stated otherwise. Promotional rates may fluctuate based on availability or season. The price confirmed at the time of booking is final and non-negotiable.
A 25% non-refundable advance payment is required to secure your booking; the remaining amount must be paid at the time of check-in to the resort or homestay. - 3.3 Accommodation & Facilities: We provide clean, safe, and comfortable accommodations selected for reliability. These are not luxury properties unless specifically mentioned. Amenities vary based on category and availability.
- 3.4 Fitness Requirements: Trips may include activities such as walking, sightseeing, and mild trekking. Guests must ensure that they are physically and mentally fit to participate. We are not responsible if a guest is unable to complete the trip due to fitness limitations.
4. Food and Dietary Restrictions
Meals are based on Kerala style and standardised for all participants. While we make all the efforts to accommodate general dietary restrictions, we are not responsible for individual taste preferences or regional food requirements.
5. Risks and Liability
- 5.1 Risk Acceptance:
By booking with us, you voluntarily accept the inherent risks associated with travel. We are not liable for injuries, accidents, or incidents occurring during the trip. Only basic first aid may be available; advanced medical care cannot be guaranteed. - 5.2 Behaviour, Illegal & Alcohol Use:
All guests are expected to maintain respectful behaviour toward staff, drivers, and fellow travellers. Any guest who behaves inappropriately—whether through intoxication, harassment, non-cooperation, or causing disturbances—may be immediately removed from the trip without refund. The guest must independently arrange their return travel, and the company will not bear any associated costs. - Illegal Activities & Law Enforcement :
Any guest found engaging in illegal activities—including but not limited to possession of prohibited substances, vandalism, harassment, theft, or actions violating local laws—will be immediately reported and handed over to the local police or relevant authorities. Wayanad Trip Planner LLP will fully cooperate with law enforcement, and the guest will bear all legal consequences, penalties, and expenses arising from such actions. No refund, rescheduling, or alternative arrangement will be provided in such cases. Wayanad Trip Planner LLP maintains a strict zero-tolerance policy toward the possession, use, distribution, or promotion of illegal drugs or prohibited substances. This policy applies to all guests, vendors, service providers, guides, drivers, employees, and any individuals or entities associated with or conducting business with the company.
Any violation of this policy will be treated as a serious breach and may result in immediate termination of services, cancellation of bookings without refund, removal from the premises or tour, and reporting to the appropriate legal authorities, as mandated by law.
Guests or associated parties who observe or become aware of any drug-related activity involving guests, staff, guides, drivers, or vendors are required to report the matter promptly to Wayanad Trip Planner LLP management. The company reserves the right to take all necessary actions to ensure compliance with applicable laws and to maintain a safe, lawful, and responsible travel environment.
6. Cancellations, Refunds, and Modifications
Advance Amount: The advance payment is non-refundable under any circumstances.
Rescheduling:
Allowed only in emergency situations with proper documentation.
Must be requested at least 7 days before the trip start date.
Only one rescheduling per booking is permitted.
Subject to availability and may incur additional charges.
Failure to meet these conditions will result in forfeiture of the advance amount.
Third-Party Policies: Subject to policies of third-party vendors (e.g., accommodation, transport). Wayanad Trip Planner LLP is not responsible for such policies or refund processes.
Weather- or Government-Related Cancellations:
Certain activities may be cancelled due to weather conditions, government restrictions, or large crowds. Wayanad Trip Planner LLP will attempt to arrange alternatives, but no refunds will be provided in such cases.
If Wayanad Trip Planner LLP cancels an event, a full refund will be issued within 7 business days.Sightseeing Limitations (Updated):
Some attractions (e.g., Edakkal Caves, closed on Mondays) or ecotourism activities may not be accessible on certain days. Additionally, there may be limitations on the number of tickets issued per day or sudden closures due to government restrictions, maintenance, or crowd control. Wayanad Trip Planner LLP will not be responsible for such limitations, ticket unavailability, or closures. Guests may adjust their itinerary in consultation with their cab driver or trip coordinator to ensure a smooth travel experience.
7. Additional Conditions
Accuracy of Information: While we strive for accuracy, unforeseen technical issues, pricing errors, or operational challenges may occur. We reserve the right to modify itinerary, pricing, or service details at any time. Guests must pay revised amounts if applicable.
Price Revision: We reserve the right to revise prices of any service or package at any time before or after booking. The customer must pay the revised price if applicable.
Transaction Charges: If the advance payment/balance is made using a credit card or forex card, an additional 5% transaction fee will be applicable. This fee will be calculated on the advance amount, added to the final bill, and must be paid at the time of check-in during final settlement.
Cancellation or Changes: Wayanad Trip Planner LLP may cancel or alter bookings due to unforeseen circumstances or operational issues. Alternative arrangements will be made when possible.
Liability: We are not liable for losses or inconveniences caused by errors, glitches, or changes beyond our control.
Modifications to Terms: Wayanad Trip Planner LLP may update these Terms and Conditions at any time. Changes take effect immediately upon posting.
8. Package-Specific Terms
Several package-related terms and conditions may apply depending on the specific trip or batch booked.
Bus Service Provider: Bus services for the Bangalore batch are provided by Kyros Connects under contract with Wayanad Trip Planner LLP.
Delays: There may be delays or changes in pickup/drop-off timings due to traffic or other factors beyond our control.
Extended Delays: In rare cases, delays may extend up to 2 hours based on our past travel timings; however, this is not a guarantee. We sincerely appreciate guests’ patience and understanding, as multiple passengers are picked up along the route, and timing variations may occur due to traffic or unforeseen factors.
Timing Changes: Bus arrival and departure times are approximate and subject to change.
Pickup Points: Pickup locations are fixed, but buses may park within 100–200 metres of the designated point due to parking constraints.
No-Shows: Late arrivals or no-shows will be treated as cancellations with no refund.
9. Rights of Admission
Wayanad Trip Planner LLP reserves the right to refuse admission or participation without refund if a person fails to follow terms or behaves disruptively.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any disputes will fall under the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
11. Use of Data and Media
By participating in our trips, you consent to the use of photos, videos, or other content for marketing purposes by Wayanad Trip Planner LLP. If you do not wish for your media to be used, please email wayanadtripplanner@gmail.com to opt out. We will make reasonable efforts to exclude your content once notified.
12. Guest Responsibilities & Personal Belongings
Guests are fully responsible for the safety of their belongings at all times. Although Wayanad Trip Planner LLP takes reasonable precautions, we cannot accept liability for loss, theft, or damage to mobile phones, wallets, luggage, cameras, or identification documents during travel or stay. Guests must check and secure their items while boarding, checking in, checking out, or exiting vehicles.
14. Transportation Limitations & Seating Conditions
Shared bus seating operates on a first-come, first-served basis, and specific seats (window, first row, middle, etc.) cannot be reserved. Vehicle features such as air-conditioning, charging ports, or entertainment systems may occasionally malfunction. Mechanical issues or breakdowns may also occur. These situations do not qualify for refunds or compensation. Pickup and drop timings may vary based on traffic, route changes, or weather conditions, and such delays are not considered service failures.
15. Pickup Points, Drop Points & Live Location Availability
Pickup locations are fixed for operational reasons. Due to traffic or parking restrictions, buses may stop 100–200 metres away from the designated point. Guests must arrive on time, as delays on their part will be treated as no-shows. Live location sharing, when provided, is dependent on mobile network availability and may not always function reliably.
16. Cab Usage, Driver Policies & Route Safety
Cab drivers follow approved routes and safe driving practices. Guests may not compel drivers to overspeed, take restricted roads, or visit locations outside the confirmed itinerary. Drivers will stop only at practical and safe points for meals or washrooms. Any attempt to interfere with the driver’s operation may result in immediate cancellation of cab services without refund.
